Welcome to Suborbit.al. These Terms of Service ("Terms") govern your use of our proxy services. By accessing or using Suborbit.al, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our services.
1. Services provided
Suborbit.al provides proxy services ("Services") that allow users to route their internet traffic through different IP addresses. These IP addresses are sourced from multiple upstream proxy providers.
2. No control over end IPs
Suborbit.al does not directly control the end IPs used in our Services. We source IP addresses from various upstream proxy providers, and therefore, we cannot guarantee the availability, reliability, or behavior of any specific IP address.
3. Usage and conduct
You agree to use Suborbit.al Services for lawful purposes only. You are prohibited from using our Services to:
- Engage in any activity that is illegal, harmful, or abusive.
- Infringe upon the rights of others, including intellectual property rights.
- Distribute malware, spam, or engage in any form of malicious activity.
4. Data collection and privacy
We collect and store the following information to provide and manage our services:
- Email addresses and usernames: We store email addresses and usernames which may be random or pseudonymous.
- Traffic usage: We monitor the volume of data transferred to manage and optimize our Services.
- Metrics: We keep metrics for a maximum of 6 hours to ensure service quality and troubleshoot issues.
We do not keep any logs of users' activities beyond the traffic usage and short-term metrics described above.
5. Payment processing
Payments are handled by third-party processors: Stripe for card payments, and NOWPayments, Cryptomus or Sellix for crypto payments. These payment processors may collect and store additional information related to your transactions. We do not have direct access to or control over the information collected by these payment processors. Our privacy policy links to their privacy policies.
6. Limitation of liability
Suborbit.al provides its Services on an "as-is" and "as-available" basis. We do not warrant that our Services will be uninterrupted, error-free, or free from viruses or other harmful components. Suborbit.al shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our Services.
7. Indemnification
You agree to indemnify, defend, and hold harmless Suborbit.al and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of our Services or your violation of these Terms.
8. Termination
Suborbit.al reserves the right to suspend or terminate your access to our Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms.
9. Law enforcement requests
Suborbit.al may be required to respond to law enforcement requests. We do not control the end IPs used in our Services and cannot provide specific user information related to particular IP addresses. We will do our best to assist law enforcement within the limits of our capabilities and in compliance with applicable laws.
10. Static IP stock depends on the ordering options
10.1 Static IPs are sold from the stock available at the moment an order is placed. Stock is not reserved for anyone: not when it is shown on the order page or through the API, not when you add funds, and not when our staff check stock for you.
10.2 Stock depends on the ordering options you choose: the product (ISP or Datacenter), the country and city, the network (ASN), UDP, OS fingerprint, the filters that skip IPs you had before or subnets you use, the extras (fraud score, website test) and, for API orders, the IP2Location usage type. The more options you choose, the fewer IPs qualify.
10.3 Some options are checked live when the order is placed: the fraud score, the website test and whether each IP is online. The stock numbers we show before an order cannot include these checks, so fewer IPs may pass than the number shown.
10.4 An order is charged only for the IPs it delivers. If not enough IPs pass the checks, the order is not completed and nothing is charged; an order accepted through the API and then not filled is refunded to your balance in full.
11. Balance, top-ups and cash refunds
11.1 Funds you add become balance in your account. Balance is used for orders and renewals and is not a deposit for a specific order.
11.2 Balance is refunded as cash only if all of these apply:
- before you added the funds, you asked us to check stock for the order you planned, through a ticket (Sales, "Check stock before ordering");
- our answer said there is, or should be, enough stock for that order;
- within 24 hours of our answer you placed that order, with the same product, location and options and no more IPs than we checked, and it could not be delivered.
Our answer is an estimate at that moment and does not reserve stock (see 10.1).
11.3 A cash refund under 11.2 is at most the amount you paid for those funds, less anything already spent from your balance. Deposit bonuses and other credits we added (for example a crypto deposit bonus, compensation or promotional credit) are never refunded as cash, and are taken off your balance when the refund is made. No fee is charged for a cash refund.
11.4 Card payments are refunded to the card you paid with. Crypto payments are refunded in the same cryptocurrency, to a wallet address you give us in the ticket, for the US dollar amount you paid, converted at the rate on the day of the refund; the network fee of the refund transfer is deducted.
11.5 In every other case, unused balance stays in your account and is not refunded as cash. This includes funds added without asking us first, funds added after we answered that stock was short or that we could not promise enough, an order with other options or more IPs than we checked, and an order placed more than 24 hours after our answer.
11.6 Proxy balance and server balance are separate and cannot be moved from one to the other.
12. Fair use of static bandwidth
12.1 Static IPs come with a fair-use allowance of 100 GB of traffic per active IP per calendar month (UTC), counted upload and download together (1 GB = 1,073,741,824 bytes).
12.2 The allowance is per login: your account and each of its sub-users has its own allowance, from its own IPs. Each is the number of active IPs assigned to that login times 100 GB, plus any extra bandwidth of those IPs (12.4); your account's allowance does not include its sub-users' IPs, and a sub-user's does not include yours. An IP counts as active while it is assigned to the login, has not expired and is either active or offline, whatever its product, including IPs in an IP pool; an IP in any other state (for example suspended) does not count. The number of IPs is taken when usage is checked; IPs are not pro-rated by the days they were held.
12.3 Usage is the static proxy traffic of each login in the current month, counted against that login's own allowance: a sub-user's traffic does not count against your account's, nor yours against a sub-user's. It resets on the 1st of every month (UTC). The dashboard shows your usage, your allowance and the reset date on the Static proxies page, and each sub-user's on that sub-user's page.
12.4 Extra bandwidth can be added to any static IP (ISP or Datacenter) when you order it: +100 GB or +500 GB per IP per month, at the price shown on the order page (a share of that IP's own price). It is charged once, with the order, and adds its GB to the allowance of the login that holds the IP in every month of the term that order paid for, while that IP is active. It is not charged again when the IP renews, and it does not continue into the renewed term (see 13.2).
Extra bandwidth can also be added later to a static IP you hold (or one of your sub-users holds), for the rest of its current term: at the same percentage of your monthly price for the IP, for each whole month left of the term (part of a month counts as a month), charged once to your balance when you add it. It applies at once (a stopped or slowed login works again as soon as it is back under its allowance) and ends with the term, like extra bandwidth bought with the order. An IP that already has extra bandwidth can move up from +100 GB to +500 GB for the difference in price; a smaller size cannot be added, nor the same size while it runs to the end of the term (after a renewal, the same size can be run on to the new end, for the months after it ends).
12.5 We may email you at 80% and at 100% of your allowance, or of a sub-user's (at most once each per month and login; a sub-user's emails go to your account). Once a login has used 100% of its allowance we may slow down (throttle) or stop its static proxy traffic, for that login only (your account or that sub-user; the others keep working at full speed), for the rest of the month: until the 1st of the next month (00:00 UTC), unless its allowance grows before then (for example when you order more IPs for it, add extra bandwidth to one of its IPs (12.4), or we give it a higher allowance, 12.6); the traffic then works at full speed again. A stopped static proxy answers "403 Static traffic allowance used up". The measure in force is shown on the Static proxies page. Usage below the allowance is never affected.
12.6 We may exempt a login (your account or a sub-user) from fair use, or give it a higher allowance, by agreement.
13. Changes to prices and extras
13.1 Prices, the percentages of extras and the fair-use allowance may change. A change of an extra's percentage applies to orders placed after it.
13.2 Extras are charged once, at order. An IP keeps the fraud score, website test and network it was bought with until it expires; extra bandwidth covers the term it was paid for (12.4). Each renewal is charged at the plan price in force at the time of the renewal for the IP's product and length, without the extras.
14. Changes to terms
Suborbit.al may update these Terms from time to time. We will notify you of any changes by posting the new Terms on our website. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.
